Taylor Swift Contemplating Legal Action over Supposed Topless Photo

To say Taylor Swift takes personal attacks lightly is an understatement. The singer, who often targets old flames (Pick a ballad) and critics ("Mean") in her songs, took - pardon the pun - swift legal action over the weekend when an alleged topless photo leaked over the weekend.
This weekend, the website Celebrity Jihad (which we'd never heard of before this story) posted a photo of a blonde, curly-haired girl lying topless across a bed, claiming it was a photo of the 21 year old star. It wasn't too long later that the site received the take-down notice, insisting that the photo wasn't Swift.
The picture remains posted on the website, despite the site's acknowledgement of Taylor's protest.
This brings up the main question. Why write a response letter at all if it isn't Taylor Swift (which it clearly isn't)? Would writing the letter to take it down help the star, who was in Nashville this weekend to launch her fragrance, prove that the photo isn't hers?
We must also ask, why would young (or old) female stars even allow themselves to be photographed in positions like this? Especially with hackers out there trying to make such things public?
